Sweet Victory

Teachers and to all our supporters, we are so excited and happy to announce that the decision of the Louisiana Workforce Commission (LWC) is very favorable to our cause! Congratulations to all those who keep the fire burning! Congratulations to those brave souls who stood as witnesses on our behalf! Kudos to AFT and LFT for their dedication to our cause! Bravo to the leaders and members of the Filipino Educators Federation for the needed leadership.

May this victory mean the strengthening of our efforts for justice and our advocacies to protect the rights of migrant teachers and workers. Let us remember that this development is not the end but is just a new beginning in our struggle. We expect that UPI will appeal and challenge the decision. We expect that there will be more arenas of battle. However, today we have a good reason to celebrate. But yes, the fight for justice goes on!

A Quick Review of the Findings

Despite UPI’s flimsy attempt to reclassify its operations and skirt the law, the Commission concluded that UPI is indeed operating as an employment service in the State of Louisiana as defined in the LPES (Louisiana Private Employment Service) law. As such UPI violated the said law by operating without first obtaining the requisite license. On top of that, below are the other findings of the Commission.

1. “The evidence established that UPI charged the teacher applicants a "marketing fee" which is prohibited by La. R.S. 23:111 B(2).”

2. “The evidence established that UPI collected placement fees from the teacher applicants "prior to actual commencement of work" in violation of Section 107.A.5 of Title 40 of the Louisiana Administrative Code.”

3. “The evidence established that UPI collected fees from teacher applicants who did not ultimately commence work on the job procured by UPI in violation of La. R.S. 23:111 B(3)(e) and Section 107.A.6 of Title 40 of the Louisiana Administrative Code.”

4. “The evidence established that UPI's contracts with the teacher applicants obligated the teachers to pay UPI a fee of 10% of the teacher's gross monthly income for the first 24 months of employment. This contractual provision violates La. R.S 23:111 B(3)(a) which limits an employment services fees to the applicant's first year's gross earnings.”

5. “The evidence established that UPI violated La. R.S 23:111 B(3)(b) which requires the employment service to adjust its fee upward or downward based on the actual gross earnings of the applicant.”

A Summary of the Awards and Penalties

With the findings above, the Commission ordered the following awards:

1. “UPI is hereby ordered to pay a fine to the Louisiana Workforce Commission in the amount of $500 for violating the LPES by operating an employment service in Louisiana without first obtaining the requisite license and otherwise failing to comply with the LPES as set forth herein.”

2. “The Commission does hereby order UPI to pay litigation expenses in the amount of $7,500.00 jointly to the AFT, LFT and Avoyelles Parish Intervenors as the prevailing parties.”

3. “The placement fees paid by the Filipino teachers were charged by UPI, an unlicensed employment service, in violation of Louisiana's Private Employment Service regulatory scheme. UPI is ordered to refund the placement fees paid by the Filipino teachers to UPI.”

4. “This Commission does not have the power to impose a criminal sanction on the Defendant. The matter will be referred to the appropriate authorities as the Director of the Louisiana Workforce Commission may deem necessary.”

The LWC decision however falls short of nullifying the contract as it underscores that that is outside the powers granted to it by the law. The decision says, “The LWC is without authority to declare the contract between two parties null.” What is clear is that LWC finds the contracts in violation of the statute in several counts. And according to the AFT lawyer, if UPI “seeks to enforce the contracts in a court of law, the court would use the LWC decision to declare the contracts void.”

  3. We have won a war together! there is no reason why we can't win a battle. The teachers have been waiting for this moment, we have prepared long and good enough for our voices to be heard.

    The contract is just one of the issues and we all know that for a fact. The main issue is whether or not the teachers were exploited in one or more than many ways. Cornering the teachers to sign a very obvious one sided contract after a malicious scheme will never give UPI the moral and legal right to impose their whims and caprices over the Filipino teachers.

    Hats off to all who in one way or the other positively help this issue reach favorable results...to us teachers, to AFT-LFT most especially, to the unmentioned supporters, even to the others who keep on criticizing us...MARAMING SALAMAT!

    Teachers, let us be more inspired to move towards professional and personal growth. Let us value more than ever our principles as teachers and as Filipinos giving our beings a better perspective and proving to the world that we face adversities with conviction and pride and will never say no to a battle against exploitation, be it back in our country or anywhere else.

  4. see, tama ang hula ko na enforceable ang contract until it is declared null and void by the court of law at kailangan ibalik ng UPI ang mga kinuhang pera sainyo mga teachers. it only means that the LWC is not the proper venue to asked for the declaration of the nullity of contract....way to go teachers! file it in proper court using the decision of the LWC as your primary evidence. dito lang natin nakita na talagang may butas ang testimony ninyo pagdating sa isyu ng contracts. pagdating sa civil court make your testimony more solid para di makaporma si LULU.

  5. The LWC not able to nullify the contract doesn't mean we are at the losing end. Everything has to go on certain process. Great things in this world always begin with painful steps. We can't always stay in our comfort zone. Sacrifices have to be made. It is scary. Our decision of standing for our rights may not be popular especially to the detractors but that doesn't mean we can't do anything. We won the first battle. This is not yet the end but just a beginning. We all have to brace for something big and strong. They won't take it sitting down. They will fight! But always remember, Our God is so Great, so Strong and so Mighty and there's nothing our God cannot do. Keep up the faith. Keep praying.

  6. Congratulations to Filipino teachers of La.
    It only means that LWC does not have the power to nullify the contracts. It does not mean they are legitimate. LWC has the power to nullify certain provisions of the contracts. This was a civil case. Forward to the criminal case..

  7. Good job! tama ang strategy ninyo - attack the legality of UPI doing business in Louisiana. You're right, you can now attack the enforceability of the contract. I believe the contract will be declared void ab initio because it is the "fruit of a poisonous tree." Pero kung yung validity lang ng contract ang in-attack ninyo, di kayo mananalo dun kasi legally binding yun dahil pinirmahan ng dalawang partido. Anyway, congratulations!!!!Bang!bang!bang! -Mr. H4

Lest I be misterpreted again, ang ibig ko PONG sabihin ay (kelangan ko ng magpakahumble kasi panalo kayo sa unang round.hehe) hindi dahil hindi nai-declare na null and void ang contract ay valid na nga talaga ito. wala palang legal personality to do business ang UPI dito sa Louisiana bakit nagpapirma sya ng kontrata sa mga teachers? from the beginning, wala syang karapatang magpapirma ng kontrata dahil inexistent sya, legally.the contract is therefore void ab initio because it is the fruit of a poisonous tree. Sige na magfile na ng criminal case pero wag gawing witness yang jave na yan, pakiusap lang.

  12. Kung mag bayad man tayo ng 10% dahil hindi na nullified ang contract, irefund muna nya yung binayad natin sa kanya. Anyway isa pa lang ito sa mga kasong haharapin nya. Sa akin lang ha, Huwag talaga tayong magbayad hanggat hindi sinabi ng ating lawyer. Manalig lang na manaig ang katotohanan.

    saan kinuha ang data na 'to about the figures of what we paid for and still have to pay to UPI? nakita nyo na pati news ng america, mali mali na rin dahil sa mga kasinungalingan nyo:
    1. not 20% in the second year instead 10%.it's the other way around. Alam
    nyo na yan ang tama, right?
    2. not $5000 ang marketing fee but $1000 dollars
    only, right?

    Papano na lang kaya kung patuloy silang maaapektuhan ng kasinungalingan at kawalang utang na loob ng iba nating kababayan? if this is the case, we are not only getting their dollars but includng their journalists's credibility. So, chances are, wala na rin silang pagkakaiba sa pinas.hahahahaha.........maging kawawa din ang economy nila dahil hahawakan na lang sila ng China pagdating ng panahon.

  15. ....so hindi lang pala si Lulu ang sigurista, sobra pa pala kayo. ang sabihin nyo talagang makunat kayo pagdating sa pagbabayad ng utang. nagpapakasaya kayo sa pagshoshopping shopping yon pala may sang katutak pa na utang na dapat bayaran. sino ngayon ang mukhang pera? di ba pati na rin kayo?! we always find someone's mistakes to cover up our own mistakes. mabuti pa nga si Lulu pinaalam pa nya sa atin ang mga binayaran natin (kung anu-ano mang mga charges ang tawag nya doon bahala na sya) at least malinis ang hangarin nya - para papuntahin tayo rito. di ba? pero kayo, pasikreto pala ang tira nyo. para kayong santo nang nasa pinas pa, yon pala may masama kayong balak na ipakulong sya pagdating nyo rito. now, who is more evil? Ikaw na nagbayad na ng placement na SOBRA - SOBRA indi ka pa ba pipirma?... and the mere fact that wla kang maalala tungkol sa kontrata na pinirmahan mo eh proof na indi mo man lng nasilayan ang kontrata na pinirmahan mo...ano ba ang namumukod tanging naalala ng teacher yung kontrata na pinirmahan sa Los Angeles California...   20. eh di sana umalma ka nang pinapirma ka nila habang sa pinas pa lang pero nang dahil sa kagustuhan mong makapunta ng america, nilunok mo rin yang prinsipyo na sinisigaw mo dahil gusto mo ring magparami ng pera! nilunok mo lahat ng prinsipyo mo dahil alam mo na kahit kamag anak mo hindi ka kayang tulungan para makapunta dito. ginamit mo rin si Lulu para sa hangarin mo. kasi kung hindi din dahil dyan sa kagustuhan mong magparami ng pera, eh di hindi ka na sana gumastos ng mga siningil sa'yo ng PARS at UPI! manggagamit at walang utang na loob! tandaan mo na ang utang na loob ay hindi mababayaran ng kahit ano pa mang halaga. kahit nagbayad ka pa ng libulibong dolyares. tama lang din na nagbayad ka ng malaki dahil gahaman ka rin pala. Legally speaking syempre USCIS ang nag approved ng visa mo at EBRPSS ang employer mo dahil hindi naman yan ang papel ni Lulu, di ba? MAG_ISIP ka! Logically, gusto kong ipaalam sa'yo na kung hindi dahil kay Lulu, hindi ka nakatapak sa lugar na to. Ni hindi mo nga siguro naiapak yang mga paa mo kahit US embassy man lang sa pinas di ba? lumingon ka sa pinanggalingan mo!

US embassy schedule na naningil ng P1000.00 to think na ang group scheduling ay nagkakahalaga lamang $10.00... ang Medical Exam na iba ang rate kapag PARS ang nagrecommenda... LAHAT yan bayad kaya wla kaming dapat tanawin na utang na loob.

    Indi kababaan ng IQ ang indi ipinaalam...nagtanong ang teachers ano ang isinagot...pinagpasa na ng requirements at pinagbayad...Bkit kanino bang credentials ang ipinasa? kanino work experience ba ang tinignan? kaninong pera ang ginamit??? Ikaw ang mababa ang IQ... sa kababaan ng IQ ni Lulu at ang mga kampon ni Lulu, wla silang ibang alam gawin kungdi mang take advantage na lng ng mga tao para kumita...eh ano ba tingin nya sa mga teachers? tanga? indi marunong umalam sa batas at mga karapatan nila? Akala kasi ni Lulu walang aalma, pero may hangganan ang lahat...sino ba ang nagumpisang mangkanti indi bat si Lulu naman? Ngayon na natutong magpumiglas ang mga teachers, ibabato nyo ngayon na walang utang na loob.

    Sa kampon ni Lulu, o kay Lulu mismo na cguro sa oras ngayon eh nanggalaiti sa pangyayari...
    Indi utang na loob ang pinaguusapan dito at wag na wag mong ibabato yan dahil bayad lahat yan...ang alam ko sa salitang utang na loob eh pagtulong na wlang hinihinging kapalit...pagtulong na bukal sa puso...indi ang man-take advantage ng tao.

    Kya ikaw na kampon ni Lulu o si Lulu...iresearch mo muna ang origin ng salitang yan...dahil indi mo naiintindihan ang ibig sabihin ng salitang yan.

Walang ibang pdeng mag ayos ng ticket mo kungdi sya lamang...Syempre chance na nnaman na makalikom ng pera.

    Tsaka wag nyong sasabihin na kung wla ang si Lulu eh wlang susundo sa airport o wlang mag aarrange ng lahat...ano ba ang ipinagduduldulan nyo sa mga teachers noon...indi bat instruction nyo yon? Dahil indi nman tanga ang teachers pra di nila makaisip ng paraan makapunta sa Baton Rouge...Sumunod lng sa instruction...kaya mong maibring up yan issue na yan.

    Ang bottom line pa rin ng lahat... sino ang nagumpisa ng problema...tanungin mo sarili mo Lulu...maayos sana ang negosyo nainisip mo pero iba nga nman ang nagagawa ng pera... Nababago lahat ultimo itsura mo.

    Tsaka yng sa shopping??? Okay ka lang kanino bang pera ang ginagamit? pera mo ba Lulu? Pinaghirapan ng mga teachers yon, pinagtrabahuhan indi galing sa bulsa at pinaghirapan ng iba...sa sariling kayod.

    Bkit ba pinag-gigilan mo ang pagshoshopping ng mga teachers?? Pano gusto mo kasi na imbis sa kaban ng Amerika mapunta ang pera nila...gusto mo sa kaban ng agency mo...kaya ganun na lang ang pagpuntirya mo sa pagshoshopping...indi ba? =)

    Indi lng ang PARS ang nakakapag padala ng teachers sa Amerika... madaming agency dyan sa Pinas... nagkataon lang mabilis pumrocesso sila... pero pera perahan nman yon di ba kaya bumilis ang processo??

    Makaapak kami sa Amerika khit wala ang PARS...kaso nakapagsubmit ka ng mga documents sa knila...pumasa ka sa interview... nagbayad ka...at dahil nag bayad ka...aatras ka pa ba?

    Magisip ka nga? wag mo masyado ilagay sa pedestal ang PARS at UPI.

    Indi pagiging gahaman ang maghangad ng mas magandang buhay para sa pamilya nila...daan ang pagtratrabaho sa Amerika pra kumita ng dolyares na maipapadala sa pamilya sa Pinas... indi yon maikukumpara sa kagahamanan na ginawa ni Lulu.

    Indi ako Diyos para manghusga ng patutunguhan nya kpag namatay sya... pero anong pinagkaiba nya sa isang santong kabayo ( natatawa ako ...hihihihi...sayo =p )

  32. ganito lang yan mga teachers, get even lang kayo ni Lulu sa kasong ito. ang kontratang inyong pinirmahan ay valid kasi na met yong basic requirement ng batas na "meeting of minds between parties". now, yong sinasabi ninyo na ito ay void ab initio ay kailangan i-prove ninyo with clear and convincing evidence that there was indeed intimidation, coercion or use of force in signing the contract. ito lang ang requirements para ma-declare na void ab initio ang contract other than that wala na...wag na gamiting rason ang gutom kasi wala yon sa mga basehan. you have your time in court to prove it but you failed to convince the court that those requirements were present. i doubt that LWC has no jurisdiction on this matter because why did they nullify the contract partially not fully? if they can partially nullify a contract then they have the authority and jurisdiction to nullify a contract totally. remember, teachers the question that you should ask yourselves when you file another case to nullify these contracts is, can we show a more clearer and convincing evidence? if you think so then proceed but if not you may end up get even with LULU monetarily. LULU will surely refund you with your placement but you have to pay her the 10%. you can still get more than just money from LULU by filing a criminal case and for sure she cannot get away with it. mark my word she will do what she has done in the past to plead guilty on all counts of cases that you're going file to avoid longer time in prison. anyway, those are only my guess and i hope i'm right again with this for the second time....

    Ang mga teachers ay indi nagtratrabaho para magserbisyo sayo...ang trabaho mo eh cguraduhin maayos ang serbisyo na ibibigay mo sa knila...indi nman pera ang issue dito...nagawa nga magbayad di ba...indi umangal makarating lang sa Amerika at kumita ng dolyares.

    Pero ano ang nangyari. Cguro nman sa dami ng kinita mo sa placement ng mga teachers ano man lang ba sana na nag-hire ka ng tao mo na magoover see sa kapakanan ng teachers. Kaso ano ginawa mo. Nagpadala ka sa sumbong ng mga alipores mo (lalo na ni Ms. Responsible) Bawat kibo't ng mga teachers may comment ka.

    Siguro sumagi din sa isip mo na nagpadalos dalos ka ng kilos mo... pero huli na ang lahat para maibalik pa ulit ang tiwalang unang ibinigay ng mga teachers sayo...sana inalagaan mo yng tiwalang yon.

    Sana isa na ang kompanya mo sa maunlad ngayon. Pero nasira lahat yon... Kung anong itinanim sya ring aanihin... lagi mong tatandaan yan.

UPI was supposed to get 20% of our income on those 2 years that we work under the service of her agency.

    Marketing fee was $1000.00 plus the processing fees and other fees...plus interest...damages...so on and so forth.

    Kulang pa yan sa problemang ibinigay ni Lulu sa mga teachers...Lalo na sa mga teachers na winalang hiya ang papers kaya na-deny ang renewal ng petition nila...sa mga teachers na kailangan lumipat ng ibang district at magbayad ng fees para transfer of employer.

  47. I don't think Mr. Dillworth's resignation has something to do with what's going on. I remember he told us during a meeting with the Fil. teachers that his wife is sick. Probably he wants quality time to take care of his wife.

    Eva Adolfo has her own principles in life and is serious with her job. Let us not be judgmental with these people.

    Let us comply with the responsibilities given to us by our employers. They need certified teachers. Let us pray for one another and believe that at the end of storm is the golden sky.

  49. The Filipino teachers are certified and most are highly qualified already. But let us admit it, not all can be exceptional in our field and kudos to the few among us who have carved a mark that Filipino teachers can do better even faced with hardship, loneliness and other challenges.

    Eva Adolfo is one of the few.

    What was presented in the media as reasons for Dilworth's resignation is by far what we know and it is very dangerous to make presumptions. EBR has many concerns aside from our plight. Dilworth inherited a problem he didn't do, let us not be judgemental but we will remain to be vanguards for truth as only truth will set us free.

  52. Someone is again trying to attack a person that he/she definitely has no idea of who she is. I remembered how she tried to refuse when she was nominated and voted by many as one of the officers of the organization. MS. EVA ADOLFO is a woman of service but she only wanted to serve with low profile. But despite how she requested not to be voted for, still she had the position. By the way, Ms. Eva Adolfo is not the Vice President (one thing false about your research).

    Those of us who have directly encountered Ms. Adofo always have something good and nice to say about her.

    What I know is that she only wished to lead a prayer group, which until now, she is actively involved with. And if you ask, that is where her heart truly goes, to be with others, serve others and strenthen her faith in God.

    It may not be fair if her name be dragged into something unreputable. I encourage you to get to know her. She is one true teacher and very good friend... one person who always finds goodness in every individual she meets and I am just one lucky person who got this chance to have known MS. EVA ADOLFO.

  56. Let it be known that not all the processing of the visa had been expedited. They were just processed on ordinary regular basis but because they were for the teachers, whose jobs depend on a school year and not on a calendar year, the processing did not have to DEPEND on the VISA QUOTA for that particular year.

    Well, granting that the visa proccessing were expedited back then, it would still be too much to charge $3,920 to every teacher. As we all know, the regular procesing is $ 320.00 and the expedited processing would only require the applicant to add $1000.00 more. So, $3920.00 minus $1320.00 still means that the agency had CRISPY and DELICIOUS COLD CUTS of $ 2,600.00.

    If the agency says it went to the lawyer, I would say, "Tell it to the marines". I don't know but if I were Mr. Silverman, I would really speak up and tell the whole universe that YES UPI indeed paid me for my services but never that FAT amount of 2,600 dollars as legal fee from every teacher. Lulu just tricked me, too!

    And you know what, for all we know, Silverman, Swinford and All of US are merely victims of UPI's tricks and 'Modus Operandi' so to speak. The only difference is that we teachers just happened to be UPI's MILKING COWS... the true victims!

  57. hello Mr. Detective! i don't care about if who expedited their visa processing.my point is on the difference of what you've paid compared to the regular processing of the papers. That if you want it to be expedited, then there is an additional amount to be charged. Now, if you're complaining about the over charges made by UPI, then that's their rate!Their rate! okay? After all, UPI is a business entity. You must have gone to other agencies who are not charging $2,600. And by the way, tell me if you can found one then I won't think it over, I would certainly go with you right away. But be sure I can leave Philippines within 3 months ha... because if I can't, I will tell this straight to your eyes, "Tell it to the navy too!"

Kahit anong depensa mo kay manLULUko, wala kang logic at walang kwenta.Tingnan mo na lang ang nangyari sa mga teachers na nabaon sa utang dahil sa bwiset na PARS at UPI na yan na hanggang ngayon e nasa pinas pa. Kung naging tapat at patas ang ginawa nilang business sa Pilipinas ay wala sana silang kinakaharap na kaso ngayon. Tama lang na ipaglaban ng mga teachers ang kaapihang dinanas nila saanman sila naroroon ng sa gayon ay may dahilan para mapigilan na ang pangbibiktima sa mga teachers na nag aasam ng magandang buhay para sa kanilang pamilya sa hinaharap. Kung patuloy na gagawin ng Pars at UPI ang ginawa nila sa mga teachers na magiging applikante nila e hindi malayong maging bilyonaryo sila at dadami ang gurong naghihirap sa halip na gumanda ang buhay. Ang negosyo ay negosyo kung patas ang pagkuha mo ng karapatang kita subalit kung ang negosyo ay nilakipan mo ng pagkagahaman sa salapi na alam mong labis at di mo iniisip ang magiging kapalit sa kliyente mo, ito ay may karapatang pananagutan sa iyo. Pananagutan sa batas ng tao at mas higit sa batas ng Diyos.

    Ipagpatuloy ang laban ng mga guro laban sa mga mapagsamantalang "recruiter". Mabuhay kayong mga gurong may malasakit sa kapwa. Basbasan nawa ng Panginoon ang inyong pang araw araw na buhay at pagtuturo sa mga kabataan ng ibang nasyon.

  64. eva is one of the few quality people that i know. i have known her since 1995. i have worked with her back in the philippines for 9 nine years. she has never said bad things about other people. never heard her backbite anyone. a person with integrity, she has impeccable professional ethics. i am so grateful and proud to be her friend.

    whoever is quick to judge her character poorly has a poor character herself/himself.

It is not putting UPI, PARS or Lulu down but it is about having justice for all. We are victims of modern slavery. Our consolation here is that we are gifted with the intelligence to discern on what is right or wrong and this giftedness give us the courage to stand for what is right.

    Those who are attacking persons who have never wronged them are not sticking to the issue. They just got nothing more to say. Just ignore them because they are simply scattering morsels to distract us and are trying to deviate from what we are fighting for!

    Takot lang ang teacher na may di matinong credentials at di nagperform ng maayos pero Filipino teachers ay di dapat matakot dahil sa papel at sa galing angat pa rin tayo.

    The whole world is looking on this case too and that is one thing that will support our stay and employment here. EBR can't kick us out easily if we are doing well because they will have bigger problems if they will.

    Sana nga di damay yung mga teachers na di nakikisali...sa tagumpay at saya lang sila kasali..sa risk at consequence ayaw makisali. talaga naman.

Teachers, do not buy whatever Ms. or Mr. Anonymous is saying here. She/He just wants to bring our morale down. We do not know, he/she has a mission to create a 'cameo effect' on our record by saying things which are not appropriate for a teacher. Well, he/she is not scared for he/she has nothing to lose.   95. i have high regards to those teachers whou fought against UPI/PARS. They are one of kind... just like what happened before. Last year, a lot of teachers would like to fight against LULU, pero isang teacher ang iniwan ng lahat. Bakit? kasi mga bahag ang buntot. Mga balimbing ika nga. kasi natakot din pala. Tapos nakita ko sila sa hearing, na kasama nila.. How come? I'm sure, kapag nagbigay ng papel ang EBR, sila ang magiging balimbing na naman.. ha ha ha. Go for it songbird... hayaan mo na ang mga balimbing mong ka batch...

TABLA kayo. magbabayad ang UPI ang sobra-sobrang siningil sainyo tapos bayad kayo sa UPI ng 10%. tip lang: wag na hingiin sa korte na i-declare na void ab initio ang kontrata kasi mahihirapan lang kayo. mas mabuti pa you ask the court for the declaration of nullity of contract. ang contract void ab initio at declaration of nullity of contract ay magkaibang termino....tanong ninyo sa abogado ninyo baka ma-teknikal kayo. ang bawat legal na terminong ito ay mayroong magkaibang "requisites"....

  112. i am thrilled of upi's vengeance in the legal battle. lulu is a loose canon, as well as her director/janitor/painter " loving husband", right hand/"not a liar" (eeeeeew!) ella and cohorts.

    lulu's style is not to announce her moves. she just do her whims without much critical thinking because her moves are motivated by greed and nothing else.

    we respect everyone's rights and lulu has the right to file at any court..and what was she saying? individual attack to all those who is against her? you are right lulu! i heard that too, long time ago.

    the fact is, upi dont know where to lodge its cases for them to win. next, there is no single lawyer who can be with lulu all the way especially when lulu takes crocodile share from these lawyers...she simply changes lawyers as easy as changing her mood. third, she doesnt know whom to sue. she doesnt even know whom to ask 10% fees from. she sent demand letters to teachers from other states, on their 3rd year even if she was not the one who facilitated their employment; she sent demand letters to the terminated teachers now in the Philippines; she sent letters to teachers who were terminated but were able to find other employment not by upi's help. and that is ridiculous!

    lulu also threatened so many teachers already charging them that they created the blog. she called teachers' parents or husband in the Philippines to give them heart attack and worries that the teacher here is not teaching but blogging. crop!

    she made techers sign affidavits in her favor stipulating that our complaints are unfounded. offered and negotiated with sweet lies for the teachers not to pursue anything against her.

    lulu, you are so crafty!

    you want a game of intimidation? we learned the hard way from you! but we will not play your game. we speak of the truth and nothing else.

    check your minions in your own backyard lulu, make a loyalty check. even those in your family. and ella, check your "partner" too and his family. this is "save your ass" time in your flock now. but for us, if teachers are in doubt, we dont care less because we have more than enough not loyal teachers but faithful and committed ones in our side. i am very proud to be a part of this group of teachers and i am not scared of any of your empty threats and shameful wrath!

    obviously, it is upi and pars who are shaking and shivering. we know you will have your desperate moves this time. but your moves are anticipated and calculated and whatever that would be, WE ARE READY!

    one of lulu's gameplan is to pay a celebrated lawfirm---both for intimidation and hope of lowering her sanctions. it is better for her to pay a thousand dollars than to pay the $1.8M back to the teachers. she can also at anytime declare bankruptcy and give nothing to teachers.

    this is not a battle againts upi/pars/lulu/ella vs. teachers...siding with us in this battle are aft/pm/ngos/individuals/institutions/ government agencies in the Philippines and here/ top level and lower ranks in ebr/ community/ media and i should say the whole world. call me proud and stupid but i can tell you till the end..I AM NOT A LIAR! (quoting ella)

  116. WASHINGTON, D.C.: A Louisiana administrative law judge has ruled in favor of more than 360 Filipino teachers and ordered a Los Angeles-based recruitment firm to reimburse them a total of $1.8 million in unauthorized fees.

    Administrative Law Judge Shelly Dick of the Louisiana Workforce Commission Administrative Judge Shelley Dick ruled that Universal Placement International (UPI) violated Louisiana labor laws, like the illegal collection of placement fees “prior to actual commencement of work”; collection of fees from teachers who never got to work with the schools; compelling them to pay 10 percent of their gross monthly income for two years; and failing to adjust employment service fees according to the teachers’ actual gross earnings.

    “This is more than just a victory for the Filipino teachers who were abused by the company,” said Steve Monaghan, president of the Louisiana Federation of Teachers (LFT). “It is a validation of the rule of law, and a commitment by the State of Louisiana to protect the rights of all working people.”

    LFT and it mother organization, the American Federation of Teachers, took the cudgels for the Filipino teachers who were forced to cough up as much as $15,000 in placement and other fees by UPI and its Philippine partner, PARS International.

    No permit from Louisiana
    UPI and its owner, Lourdes “Lulu” Navarro, were also found to be recruiting teachers from the Philippines without the necessary license from the State of Louisiana.

    The commission said it would also refer the case to appropriate authorities for criminal sanctions against UPI and its owner.

    “The decision goes a long way in relieving these excellent teachers from an illegal and oppressive relationship,” said AFT attorney Dan McNeil, who argued the case for the teachers. “This ruling will now allow them to freely pursue their personal and professional aspirations.”

    The lawsuits against UPI and Navarro were filed last fall on behalf of about 360 Filipino who were hired in Caddo Parish, East Baton Rouge Parish, Jefferson Parish and the State Recovery School District in New Orleans.

    Some of those teachers arrived in the US only to find that the promised jobs were not available. Eventually some wound up in Avoyelles Parish and other school districts around the state.

    Each teacher was charged at least $5,000 by Navarro in placement fees to obtain a job, and was then required to sign a contract obligating them to pay 10 percent of their second year salaries to the company.

    Teachers who could not afford to pay the fees up front were directed to loan companies by Navarro, and were charged exorbitant interest rates.

I agree with April 25 12:39 pm mapi-feel mo talaga sa ibang lawyers na tutulungan ka nila. di ba noon ko pa sinasabi sa inyo, wala nang channels at siguradong di maiiwan sa ibabaw ng mesa ang documents mo, di ba Ms. Ella? at kahit busy sila eh sinasagot nila ang mga tanong natin. ina-update tayo sa status ng visa natin (tulad ng ginagawa ng EBR) at hindi nila tayo pinag-tataasan ng boses, di ba Ms. Ella?
    ayan tuloy ayaw na ng EBR magsponsor ng H1b for new teachers. pwedeng dahil sa economy or pwedeng nadala na sila sa palpak na service ng recruiter, di ba Ms. Ella? ano opinion mo? sumagot ka naman nami-miss namin sagot mo eh. ha! ha! ha!

  151. This is one strategy to break our solid group apart. Trying to heat people all up and get into a fight. The results would be weakened spirits, deviation from the target and failure to reach the goal. We do not want this thing to happen. Let us stop bringing in names that have no direct concerns to our quest. And yes, this blog maybe a venue for us to freely express what we feel, however, we must not forget that those other things have another venue for discussion and may even be fixed right away when properly communicated. Well, just a thought from me.

  195. kahit anong gawin mo para buwagin ang grupo namin, wala ka magagawa. iisa ang aming ipinaglalaban. yung iba tahimik lang pero kaisa pa rin namin sila. hindi kami marunong magpagamit sa kapwa namin. alam namin ang tama at mali.
