Support the class suit!

Lulu Navarro and her cohorts are now realizing (if they still haven’t realized) that indeed we, teachers, have the capacity to seriously fight back. Lulu, do you really think that you can just rob people, threaten people, step on people and expect that they will cower in a corner and shut up? Do you really think that you can get away with your oppressive and illegal operations? Do you really think that you are untouchable that by flaunting your money, your connections, and your equally corrupt lawyer, that you can do anything to exploit others and enrich your gluttonous self? Probably now you know the answers to those questions.

Well, you have underestimated us. You have underestimated the power of our unity. You have underestimated the strength of our resolve to get justice. You have underestimated the depth of our determination to bring a stop to your oppressive schemes.

Now that we, together with hundreds of our colleagues, have filed a class suit, we have opened another arena to expose your excessive modus operandi. We are looking forward to meet you (and all your lapdogs especially your officer-janitor-painter-husband) in court and expose the truth about your shady operations.

To our fellow teachers, let’s keep the broadest unities possible. We know that there are a few others, who may not agree with or do not understand fully the rationale behind our efforts. We know that some are not comfortable with the fact that we are including the EBR school district in the complaint. But please bear in mind that the main reason behind that are the actions of some personalities who represent the district which is tantamount to supporting the illegal operations of UPI and Lulu Navarro.

“We, members of the Filipino Educators Federation of Louisiana, would like to make it clear that we harbor no ill will towards the Louisiana School System. We want to emphasize that we love this community and we now consider Louisiana as our home. We think of our students as our own kids. The new superintendent has paid attention to our concerns and has closely monitored the problems we have encountered. And we have had tremendous support from the East Baton Rouge community. We will continue to give our 100 percent to our teaching vocation as we strive to push our students for a brighter future. Let me also use this opportunity to declare once again that we continue to have a strong commitment to our students, and will continue to serve the district for we believe that the actions by some individuals within the EBR School District do not represent the values of the institution and the people of Louisiana.” This is an excerpt from the statement of the Filipino Educators Federation (FEF), which we are part of. So, we are not against the district per se but we are against the involvement of those people who represented the district. If these people are found guilty conniving with the criminal Lulu, it is but proper to include them as well as the institution they represent because clearly, the district benefited financially as the fees that they are supposed to pay as mandated by law were illegally charged to us.

Also we expect that Lulu and UPI will also mobilize her minions to counter our efforts. We fully know who these people are. We expect them to come out and say that they are very happy with how Lulu treated them (rightly so because they were paid and given perks to implement Lulu’s policies) and that the events stated in the class suit are all lies. But we are not even worried about those unprincipled people for we know that the foundation of our action is the truth and we are standing on moral high ground.

To all our fellow teachers, this battle is part of our continuing efforts to get justice. Let’s bear in mind that this is not for our individual selves or our own families only, but as teachers, as responsible Filipinos, it is our obligation to help our fellow teachers here and those who stand to be victimized if this exploitative scheme is not stopped.

  1. VICKSBURG, Miss. -- Elizabeth Duran Swinford, currently with the East Baton Rouge Parish School System, has been selected as the new superintendent of the Vicksburg Warren School District.

    The Vicksburg Post reported that Swinford was hired Tuesday on a 3-2 vote by the school board.

    Board President Zelmarine Murphy said Swinford's salary has not been set.

    The board set a salary range of $110,000 to $140,000 when they began the search process to replace James Price, who retired June 30.

    Swinford will oversee an annual budget of about $80 million and a district that includes 15 schools and about 9,000 students and 1,300 employees.

  2. This is a manifestation of the worsening condition of the public school teachers in the Philipipines. Filipino teachers, being trained to love their country would not choose to leave if the Philippine government will invest adequate expenditure for public education as the constitution mandates.   3. Vicksburg should rescind the appointment of Swinford. She is a disgrace to the East Baton School district for her involvement in the UPI scam. She is a close associate of Lulu Navarro and has received a lot of "gifts" from her. The people of Vicksburg should petition the officials of their district to reject Swinford because she can easily be corrupted.

  5. President gets salary adjustment quickly but teachers have to wait forever – ACT

    Public school teachers envy President Benigno "Noynoy" Aquino III.
    After a month on the job, Aquino has already received his pay with adjustment, while teachers are still waiting for the second tranche of their salary raise as mandated by Republic Act No. 6758, also known as the Salary Standardization Law III.
    France Castro, secretary-general of the Alliance of Concerned Teachers (ACT), stressed that Executive Order No. 900 was issued by former President Gloria Macapagal Arroyo last June 23 to implement the law.
    However, more than a month has passed but the promised raise has not yet fully materialized, Castro complained.
    “Just the other day, President Noy was very proud about his first paycheck. We noticed that the amount was already adjusted. When we received our monthly salary last July 24, 2010, the amount was still the same. It did not yet reflect the second tranche of increase. Isn’t this unfair?” Castro lamented.
    “In 2008 and 2009, public school teachers and personnel led by ACT consistently attended Senate and House committee hearings and sessions to support the P9.000 salary increase payable in three years. We even marched by the thousands towards Congress to insist on the approval of the bill on salary increase. The Salary Standardization Law III was eventually approved,” she recalled. “Our increase was just minimal, and that is why we consider this as partial victory.”
    Even as the former government promised to adjust the salaries of all government employees starting June 24, 2010, and issued National Budget Circular 524 on the same day to provide the implementing rules and guidelines for the salary increase, it failed to deliver on its pledge.
    Castro said RA 6758 was enacted into law consistent with the principle of providing equitable and just wages to all government personnel.
    The same law mandates that the salaries of government employees must be comparable to those in the private sector who hold similar positions.
    Castro noted that the adjustment was to be paid in four tranches in four consecutive years.
    Every year, an executive order and a National Budget Circular are issued to provide the guidelines for the implementation of the pay increase.
    “Public school teachers are at the middle of the salary classification ladder and [are] entitled to an increase of P6,500 in four years. Positions that are in the higher level of the salary classification, including that of the President, are entitled to a higher rate of increase. The whole classification system seems inequitous. Worse, the increase due us is not available. We thought 'wang-wang' and 'counterflow' are no longer allowed,” Castro said.

    We feel sorry for these teachers who are honest and don't shy away from financial responsibilities. They make around 16,000 pesos per month, roughly around 300 dollars, while teachers abroad make as much as 6000 dollars or more a month. And yet, they have the audacity to complaint (forced labor) against their employer. A lot of american citizen (teachers) are unemployed right now. Be cautious in what you do because it might go around a bite you in the end.

  9. GOPer Gov. Bobby Jindal....is down there in Lousiana WHINING and crying about what the oil did to his state. He is whining about the unemployment rate and WHY BP show be allowed to pump oil right away because people are hurting in his state. An.....then the GOP brings in foreign low wage earners to KEEP from hiring qualified American teachers...or even future students who hope to pursue a career in education. This is the TYPE of immigration Bush/GOP loves....that kind that PUTS AMERICANS out of work....

With thousands of American teachers out of work, who in the hell cares if a government entity, like louisiana is stupid enough to hire foriegn workers to teach our children, and in the fashion of most big-business endeavors, these offshore hires are subjected to unfair treatment?   12. Why do we need Filipino or any other country's teachers here in the U.S. when we have thousands of excellent, highly qualified teachers right here in our own backyard? There are hundreds if not thousands of Louisiana teachers that would love to have the opportunity to teach their own in their own state. What the hell is this country doing bringing in foreigners when we have qualified AMERICAN teachers right here? Haven't we had enough of outsourcing, off-shoring and hiring of foreigners when we have our own. America, wake up! When you want an answer as to why unemployment continues to remain high, just remember this story of foreign teachers taking jobs that AMERICANS DO WANT; corporations snubbing their noses at American workers by sending jobs to India, China and elsewhere and employers hiring illegals to do jobs that American DO WANT TO DO. This is sickening!

Unang-una alam nila na dapat silang magbayad ng ganitong halaga at wala silang reklamo dahil gustong-gusto nilang makapagturo dito. Ngayon na nandito na sila gusto nilang bawiin yung mga binayad nila. Eto ay simpleng case ng 1-2-3. Hindi ako naniwalang blinded sila sa halagang dapat nilang ibayad. For me this is just plain stupidity sa mga Guro o sinumang nagpasimuno nito. Kagaya din sila nung mga iilang pinoy teacher na swapang sa texas na walang inisip kung hindi mga sarili lamang nila. Shame on you coz you. Sinong private agencies pa ngayun ang maglakasloob na mag-recruit ng mga potential pinoy teacher if things like this keeps on happening? Nakapanghinayang!!!!!!

You are saying that its ok that these exorbitant charges, dishonest and non-transparent recruitment schemes and threats continue as long as you are here in America?     Contrary to your assertion, there has been a shortage of teachers in Math, Science and Special Education here in the US since at least 5 years ago. Are you not wondering why US kids lag far behind in math and science compared to many developed countries? There must surely be a problem with the US' educational system and the lack of qualified teachers is one of the factors exacerbating the problem.

  23. It does not follow that because the process by which these teachers are brought into the US is tainted with illegal activities, it then means that their H1B visas are not valid. The document is valid, their work visas are valid. but there were laws violated relating to the exploitation of these teachers.

    H1B visas are non-immigrant working visas involving a “specialty occupation,” which requires special skills in that particular field. This type of visa is granted as long as the foreign professional have at least a bachelor’s degree or its equivalent.

    It's very funny that after the decision of the LWC, a lot of those two faced freaks pretended to agree with this cause and even wearing white to pretend they have been involved...was it because of the supposedly refund of fees? It is ironic that the very people leading this so called group that wants to opt out of this cause now are the very ones who believed that there was politics involved in our hiring thats why we arrived here so fast!     As much as this is what we want to happen but the facts of case remains that the school district through its representative, with their knowledge, tolerated and cooperated with the modus operandi of Lulu. We cannot simply sweep those facts under the rug.

    It's not right to apply justice selectively. and the current leadership of the school district understand that. In fact it is in the best interest of the district (and the public), to have these issues come to light so that they will be able to identify those officers who abused their authority.

  35. Further, such is the nature of a class action lawsuit. It's not always feasible to talked to every single person who constitutes a "class". Just like in any class action lawsuits, some would want to opt out especially when you do not share the experiences of the rest in the class or you prefer to lodge a separate complaint.

    There will be a way to opt out and the leaders of FEF will surely assist those who would want to do just that. Just remember that opting out of a class suit means that you will no longer be eligible to share in whatever judgment that will come out of the case, either positive or negative.

    We already have the numbers, and as much as we would like more to join us, we are not forcing anyone. Just keep an open mind, make a decision and exercise your right.

Response po ito kay gurong-sulong...good day po sa iyo, tanong ko lang po bakit mo sinasabi na pwede naman mag-opt out sa pagdemanda sa EBR kung ayaw... eh marami naman ang hindi nag-opt in or pumasok sa kaso...bakit may choice na mag-opt out..... hindi naman alam na kasama sila sa demanda nyo, nabigla nga eh.... you included our name without our consent...Oo nga okey lang po na wala kaming parte kung manalo kayo, basta huwag lang kami madamay sa kaso againts EBR. We will respect you and your groups decision. Sana naman respetuhin nyo rin ang desisyon namin. Hindi namin sinisira-an kayo or ang kaso nyo... gusto lang namin matanggal ang pangalan namin sa pagdemanda sa EBR sa lalong madaling panahon, ayaw namin hintayin yung sinasabi mong mag-opt out.. kasi may MOA-Memorandum of understanding na kahit 3 years ang VISA mo, pero every year ang evaluation mo at anytime pwede kang ma-tsogi. EBR has the capacity to do something. So, please huwag nyo naman masama-in ang action at sira-an si Waren at Depol, di po nila pinilit yung mga teachers kasi may mga isip at talino po sila. I assure you, wala pong kinalaman si Lulu dito at wala kaming tinatanggap sa kanya na gawin ito. Pare-preho lang tayo na na-api ni Lulu,di lang kayo, so bakit kami gagawa ng favor para sa kanya Hindi po kami namimilit, i-no-open po namin sa lahat ito para transparent at di kami mag-mukhang selfish, concern din po kami sa kanila kaya pina-alam at ganon rin para di kami masisi, kung ano man ang resulta.   42. Many of us, by struggling and saving, are able to buy used cars and rent better appartments (than the one forced on us called Savoy) and are able to go to eat out once in a while. So whats wrong with that? Why are you so concerned with how other people spend their money? Stupidity indeed...

  43. Anonymous, the reason that you have to opt out is because of the very nature of a class action lawsuit. That is how class actions are. A pattern of violation against a group is proven to show that the rights of a class was violated. So in a class action process, that is how it works: a portion of the class will file a complaint first, then and only then can those who do not want to join can opt out.

    For example, Lulu's Cup Cakes distributed by Swinford Foods Inc in Louisiana was proven to contain harmful bacteria. Now members of the class (those who consumed Lulu's Cup Cakes) filed a class lawsuit against Lulu's Cup Cakes as well as against the distributor. The part of the class who initiated the lawsuit couldn't possibly talk to all who consumed the toxic cupcake and check who wants to join or not. But regardless, what has happened is that most of those who ate the cup cake got sick. Now if some consumers later came out and say they are big fans of Lulu's treats, that cup cakes are good, and they didn't get sick then they can opt out of the case.

    So walang personalan. We will respect whatever decision you take. But don't accuse us of being disrespectful to you because as we have explained that is not the case and there was no intention to disrespect you. That is just how it works.

  44. Ay dapat pala para mas accurate, I named the distibrutor as EBR Foods Inc. The consumers actually have no ill feelings towards EBR Foods Inc because this company has been around and has a good reputation. The distributor was only dragged into the case because Beth, the errant employee, allowed the toxic cupcakes to be sold despite knowing about the contamination.

  52. we respect the right of anyone who wishes to express what they think is right and beneficial to him, hence we respect the efforts the small group of teachers are doing right now, particularly the manifesto stressing that they are not part of the civil case filed by the vast majority of Filipino teachers in the whole of Louisiana.

    each has chosen where to side, be it pro or against the abuse, or at the middle and careless. we also has each level of tolerance to exploitation as well as intensity of principles. likewise, all of us has each priorities, some cares for noone but themselves, or their families, while there are who are made to fight for others welfare.

    it is just sickening to see that as teachers and as Filipinos, our views are polarized for whatever reason or pressures teachers have.

    i still have high regards for those idealistic teachers who can't stand any kind of unjust practice and i pity tough i can't blame those who are instruments of abuse. i pity also the others concept and precept of the matter, i am sorry if there was a lapse or communication black out before which isolated you from the information of the merits of this case. we are opening now the liberty of info dessimination on the real score of the case and how it evolved, where it is heading and why it was filed the way it was filed. a legal debriefing is scheduled purposely for the group who wants to know the answers of said questions.

    but then, the small group of teachers is hasty in the decision of not hearing the legal and moral side of the matter. whatever your motives are, we should not care.

  60. Sumulat kayo sa school niyo at ipa NOTARY public seal niyo na hindi kayo kasama sa civil lawsuit. Kasi kapag nag apply tayo sa ibang eskuela, hihinge sila ng recommendation o kaya itanong kung may demanda ka sa school mo dati. Sasabihin sigurado ang nangyari sa lawsuit at tatanong kung kasama tayo. Hindi lang nag sasalita ang school at naka smile pa sa iyo pag nakita ka, pero alam nila kung sino ang nag-demanda sa kanila. Check in niyo kung nan doon ang name niyo kasi baka sinama ka or tayo para mapalakas ang case nila. Siguro ako na may mangyayari next year na hindi natin gusto. Hindi ka tutulungan na union kasi yun ang gusto nila na mapa-alis tayo. Kasi ginawa ng union sa NewYork na ito at texas. Bumalik na ang mga kasama ko kasi hindi sila makakita ng TRABAHO dahil may case sila sa school nila. Basta importante ang pamilya natin at magsikap tayo.

Yes, even in the FEF statement we are already being open about that. May nagsabi be na hindi kasama ang EBR sa respondents? Wala naman a. But read our complete statement as it clarifies the group's position on that issue.

    Who said I am forcing you? I am not. Do not stop me or anybody here from posting explanation or opinions why we think your reasoning is wrong. Remember, I am not posting here for you only but for all to read and consider. I am writing to explain the nature of a class suit because apparently you are ingorant of it. I am only explaining why in a class suit you don't have to talk to every single member of the "class" before filing the lawsuit because of feasibility considerations among others.   81. Nobody is promising anybody visa renewal here; not the school district, not SPLC, not AFT or LFT, and not FEF. Making sure that you perform well in your school will be the best way to achieve that. If you are fired, despite of that and without valid reason or due process then that is an issue that we are willing to help.

    Remember that what we are fighting for here is to correct the injustices that were committed. So as long as we perform well and be vigilant of our rights, then there is less reason to be insecure about our employment.

    Balikan mo nga yung napag-aralan mo sa grammar particularly rules on commas and punctuation marks. if you are enumerating things or persons and you separate them with a comma, it means they are not the same, they are different.

  94. To all teachers, if you have analyzed all the facts, you understood all repercussions, and you know deep in your heart that you don't want to be part of the class action lawsuit, then by all means we are encouraging you to sign the manifesto.

    But if you have some doubts and if you have lingering questions, there will be a discussion on Saturday and an AFT lawyer will be here to thresh out the legal move. All you have to do is hold your decision and keep an open mind and listen.

    If after the discussion you think that you don't want to be part of the lawsuit then there is definitely nothing wrong with that.

    i stand corrected. salamat. (though we know that silverman is really the lawyer of UPI and Lulu, but you are correct that silverman is technically also the lawyer of the district in the filing of the petition.)

I dont think so. I still have faith that the people in the district are intelligent and professional enough despite the lawsuit to retain those that really deserves.

    nobody here (SPLC, AFT, LFT, FEF and even the school district) is giving assurances of renewal of visa or continued employment. pero ngayon kung patatalsikin ka ng district dapat talaga may valid reason and may due process, otherwise pwede ma-interpret na retaliation (kung part ka ng lawsuit). for sure the district will now make sure that laws are being followed as they would not want to be slapped with another labor suit.

You try to present us as evil who are out to only get money but you failed to even think that what you are doing is against the Christian value of helping your neighbors and not only yourself.   134. I am a Filipino now based here in Middle East and have little knowledge about the law. Based on the news reports (CNN, etc.) and this blog. My advise to the group pursuing the case against the employer is that be careful in all your actions because in the end you might be the one caught in the thread. Do not force your fellow teachers to subscribe in your motives or use their names without their permission to be included in the case - class lawsuit. If you do this, this might constitute an unlawful or unauthorized use of identity which is punishable under the law---most countries including the USA has laws applicable to this--that the other group might be used against you. Do not force them as Miss. Cruz said, "to the point of no return" they might file an action against your group. As I said, Do not use others identity or name without permission for your own personal gains becuase it is punishable under the law.

    To the group that doesn't support this class lawsuit against your employer stay focus on your job and do not subscribe to the other group of thinking which I believe their motives is to enrich themeselves in a very unnatural ways. Still, love them. Whether you like it or not they are still Filipinos. Do not make any action(s) unless you are force to do so and let the court do their job on this class lawsuit. Have PEACE in your HEART...

  145. Why are we focused only on EBR? If you read the totality of the complaint, the focus is against UPI, PARS and Lulu Navarro.

    By saying that this class action lawsuit will cause the EBR school district to fire us then you are in effect saying or assuming that all or most members of the EBR board are all biased, unreasonable and hateful people. We believe otherwise.

    We trust the school board will act with the best interest of the district and the community. And that can only be done when justice is attained. The EBR district for sure would not want this to happen again and it is in their interest that those within their ranks who collaborated with the criminal Lulu in implementing the oppression should not go unidentified and unpunished.

I am talking about the class suit on how it was being filed and on how your group tried to include others' names in filing the case. THERE IS NO FREEDOM IN THERE because the group never made a consensus to all Filipino teachers if who are only willing to join. The consensus, the meeting, the info dissemination, or whatever was made right after the case was being filed. RIGHT? And even until now, even there is already a move of making that manifesto still you don't stop convincing them of joining you in pursuing the case. STOP using the name of the filipino teacher's federation the mere fact that NOT ALL Filipino teachers are members of that organization.It's now being cleared that you've proposed the creation of such group for your own personal interest. One is purposely for filing the case in which you think will make the move more believable, legal, reliable and strong because it represents a certain group. I must tell you this you will not succeed. Matapang lang kayo dahil may sinasandalan kayo. Anong mangyari sa mga teachers pagnagkataon na matalo o manalo man ang kaso? Defendant Lourdes Navarro and Defendant Villarba were charged in California with health benefits (Medi-Cal) fraud, grand theft, identity theft, money laundering, forged identification and white collar crime in 2000. Lourdes Navarro pled nolo contendere (no contest) to the charges that she, with others, willfully defrauded more than $1,000,000 from Medi-Cal, and served time in Orange County Jail for this conviction. A warrant to arrest Villarba was issued, but years later was recalled by the court and the action against Villarba was dismissed. Upon information and
    belief, Villarba fled the jurisdiction.

    75. Defendant Lourdes Navarro pled guilty to a charge of money laundering in New Jersey in 2003.

  173. Anyone who has suggested that the lawsuit is "ILLEGAL" because it was filed as a class action is just plain wrong.

    First, there are only 5 named plaintiffs. The whole point of bringing a class action is based on the fact that the class is too big to name everyone.

    Second, who would believe that SPLC, AFT and Covington & Burling would file an "illegal" lawsuit that would subject its clients to liability.

    These are pathetic scare tactics.

    Finally, Lulu filed the baseless (or in your words "illegal") lawsuits. The trial court threw it out and the appeals court agreed that Lulu's case was baseless and an attempt to stop free speech.

    all those allegations constitute criminal offense. why did your group file a civil case-class lawsuit? it would be more believable if you file criminal case first then from the decision of the criminal case, in case you get them convicted, you file civil case. this will erase the notion that you are only after the money. since you do the civil case first, the notion of monetary gain is and will alwayd be attached to your group.

    who told you that it is illegal? Not your group or the other group can tell and declare that the case filed is in accordance or not with law. Not even your group's lawyers or the other group's lawyer - if they have it now - can tell and declare that the case filed is in accordance or not with law. IT IS ONLY THE COURT THAT HAS JURISDICTION TO TELL US ALL WETHER OR NOT THE CASE FILED IS IN ACCORDANCE WITH THE EXISTING LAWS.

    NOBODY IS TELLING OR SUGGESTING THAT THE CASE FILED IS ILLEGAL. THEY DO NOT QUESTION THE MERIT OF YOUR GROUP'S CASE. WHAT THEY ARE ASKING IS THAT WHY DID YOUR GROUP DRAGGED THEIR NAMES INTO THIS MESS WITHOUT THEIR APPROVAL...THAT'S IT!

By repeating and repeating the accusations that our motive is just to get money, he thinks it will stick out as truth. That is the only way he can at least paint us in a negative way. Good luck.

  180. one piece of advice...go get great a team of great lawyers so that you will not be mislead.

    who says that your names are in the case? the only teachers whom i know bravely risk everything to lead the stand upfront for what is right are the five teachers. other than the five teachers, no one else is named suing the defendants of the case. however, there are more teachers who are backing them up which made our legal team decides that there is indeed a merit for the case to be a class suit.

    filing the way it is filed is the first step to have a class suit...some bodies will be named in the filing first and ask the court to determine if such case will then be a class suit.

    once filed, the court will determine now if there is a merit for the case to be considered as class suit.

    if the court deem say it is indeed a class suit, an opt-in, opt-out process will then be provided to the members of the class. that is the time when you need to decide finally if you wanted to take part in the law suit.

    those who have signed the retainers simply grant the lawyers to represent them legally and to defend them legally in any court.

    again, as of this moment, only the 5 named teachers are at risk and nobody else.

    suing the school board took a while to be finalized. it took a lot of discussions from the legal institutions and the stakeholders. it is a legal step we need to take. believe it or not, the school board has something to say on this and hear this, it is not against the the case. the school board were not sued on a personal capacity unlike the three named defendants of ebr and for sure, the board as public servants (their election coming up), they will be on the side of truth and justice.

    if you want more clarifications than what the ordinary struggling teacher can give you, kindly attend the case review during tomorrow's activity. you know whom to ask if your interested.

Maliwanag naman na pinaiikot niyo lang ang usapan. Si Lulu lang ang dapat kasuhan at kasama niya hindi ang kumpanyang ating pinagta trabahuang lahat. Hindi porke sumama sa manifesto eh tuta ni Lulu. Sabagay yan ang inyong masamang pag-iisip everytime na di sumasama sa inyo tuta ni Lulu, nagkataon lang na alam ng mga guro na ginamit niyo sila at kahit anong sabihin niyo a class of fish will always be collective, not singular!Asaan na ang sinasabi niyong declaration ni Supt. Ano ba ang proteksyong ipinagmamalaki ni ingrid?yung letter na pinirmahan ng southern poverty law center na nagsasabing bawal galawin ng ebr ang sinumang teacher na nagsampa ng kaso habang itoay nililitis?yan ba ang sinasabi nyong protection ninyo?what if magdeclare next school year ng Reduction in Force (RIF)?sa tingin ninyo kaya kayong protektahan ng letter na yan?HINDI!pag may RIF, unang tatanggalin ang ang H1B worker.sa tingin ninyo makaka-apply kayo sa ibang parish or district or state?saan kayo kukuha ng maayos na recommendation letter kung nasa file/record ninyo na kinakasuhan ninyo ang employer ninyo?

  190. hindi po nanghikayat yung mga teachers na pumirma sa manifesto para hindi ma-qualify na class action lawsuit ang isinampa ninyong kaso.in fact, one hour before the signing of the petition lang nila nalaman na pwede palang hindi ma-qualify na class action lawsuit yang case na yan.

    on the other hand, kaya gustong magpaliwanag and at the same time manghikayat ng supporters ang lawyers nina ingrid dahil alam nilang malaking pera ang makukuha nila kung class action lawsuit yan.

    This is such a close-minded assertion. So what you are saying is that kahit may mga violation ng batas ang employer, ok lang? ang gusto nyo sumipsip because umaasa kayo na dahil sa pagsipsip nyo you will have a better chance of staying in your job.

    So binobobo nyo ang school board as if they will give you a favor because you are not part of the class action. We still believe that the school district as an institution is more professional than how you perceive them.

    We believe as we have asserted before that the new superintendent and majority of the board are professionals who have the best interest of the district and the children of East Baton Rouge in mind. They will not go on firing Filipino teachers at will because of this. They will always think what is best for the community.

    The problem with your premise is that you don't trust the school board to be fair and objective.

She stands to reap the rewards if we don't pursue the class action.   195. This person thinks that many will fall to his/her senseless comments. So in summary there is really nothing very intelligent in his/her arguments. All that this person highlights is that all teachers supporting the lawsuit are greedy and all lawyers helping us have vested interests.

    During the case at LWC, nobody said that we are greedy and our lawyers have vested interest. Now, in the class action lawsuit which is spearheaded by the same group of teachers and the same lawyers, we are suddenly greedy and the lawyers have vested interest.

    Why? All because we included the EBR district in the case. But as we have explained, rightly so, as that is the principled thing to do. We cannot have selective justice.

    But, ok, we accept that some are not comfortable with that move of including the district. But does that make the people behind the case transform from being the brave teachers in the LWC case, into the greedy teachers initiating the class suit? Does that automatically convert those good lawyers at the LWC hearing into lawyers with vested interests?

    That is just plain mud-slinging. The fact is, this person and Lulu are afraid for you to come tomorrow in the discussion. They know that their arguments against the class suit and against including the EBR district in the suit are so weak, and attending the discussion will open your mind to the correctness and justness of the action.

    We challenge you to come tomorrow and be brave enough to present your "greedy and vested interest" argument in front of everyone. See you.

  196. I agree that no one us has the immunity that our current employer will keep us. Remember the 30+ teachers who have been terminated by this school board for no reason last 2008? Was there no violation took place? Was there justice served for these fellow Filipino teachers? Remember, they've got families too, spent almost the same amount of money as we've spent. Just like anybody else here, I am scared to lose my job too. Who doesn't anyway? I suggest, reflect, assess and make own personal judgment for this issue. I have read, that both groups has different views on suing the school board. I agree. But what circumstance just like I said we are immuned to such firing if they wish to do so? Honestly, right now I am on a 50-50 stand on where to ally. But I have deaf and blind for so long. We are not lawyers, nor experts but remember we are Filipinos. Let us consider everyone. If we are not going to make a stand who will stand for us on behalf of this dilemma. The world is watching us. Lets settle this peacefully, professionally and let us not forget it must be for the welfare of all. If respect is the complete element to have this settled then lets talk and discuss this over the table. I will in your place Aft. Just make sure you will answer all my concerns. I don't wanna be one of those teachers who have fired! terminated! discharged! for no reason at all now that the ebr has the means to do so. Oh by the way did you helped them out?   199. Thanks for this day, our noble dreams and intentions are getting clearer and we know God is always guiding us. To tell the truth and stand up for what is right is a humbling experience. It reminds me of Jesus Christ who died on the cross to save us from sin.He never thought of his life,nor his own green card . His love for mankind ruled over his own self . What an unselfish love. When can people learn to put the cause of the majority a priority instead of their personal selfish motives ? When? Why are they so afraid of not getting the green card when in fact they will never get it with or without the case? If you put your trust in God ,you have nothing to be afraid of losing. If you are on the side of righteousness, and think less of yourself,God will make a way when there seems to be no way.
